Terms & Conditions

"Platform" refers to the WCFAuction.com and WorldCelebFinds.com websites, their mobile applications, APIs, and any related services operated by WCF Global Holdings LLC.

"Item" means any physical or digital good listed for auction, raffle, or direct sale on the Platform, including memorabilia, personal objects, clothing, instruments, vehicles, jewelry, and any other celebrity-origin goods.

"Seller" is the celebrity, artist, athlete, or authorized entity that lists an Item on the Platform. All Sellers must be verified and approved by WCF Global Holdings LLC before publishing any listing.

"Buyer" or "Bidder" is any registered user who places a bid, acquires a raffle ticket, or makes a direct purchase on the Platform.

"Hammer Price" is the amount of the winning bid at the close of an auction, before the addition of the Buyer's Premium and applicable taxes.

"Buyer's Premium" is the additional percentage on the Hammer Price that the Buyer pays to the Platform as a service commission.

"Blockchain Certificate" is the immutable blockchain record that certifies the authenticity, provenance, and chain of custody of each Item listed on the Platform.

"Authenticity NFT" is the non-fungible token linked to the physical Item that contains authentication metadata, the delivery video, and the Seller's digital signature.

To participate in auctions, raffles, or direct purchases on the Platform, you must: (a) be at least 18 years of age or the legal age of majority in your jurisdiction, whichever is greater; (b) have legal capacity to enter into binding contracts; (c) not be on any international sanctions list; and (d) provide truthful, complete, and up-to-date registration information.

Each user may maintain a single active account. Creating multiple accounts to circumvent suspensions, manipulate bids, or accumulate raffle tickets constitutes a serious violation of these Terms and will result in the permanent cancellation of all associated accounts and possible legal action.

The Platform reserves the right to request identity verification (KYC) at any time, especially for transactions exceeding USD $10,000. Failure to meet verification requirements may result in account suspension and fund retention until the process is completed.

Residents of jurisdictions where online auctions, raffles, or cryptocurrencies are prohibited or restricted are responsible for knowing and complying with applicable local laws. The Platform assumes no responsibility for the use of its services in violation of local laws.

BINDING NATURE OF BIDS: Every bid placed on the Platform constitutes a legally binding purchase offer. By placing a bid, you agree that if you are the winner, you are obligated to complete the purchase at the Hammer Price plus the Buyer's Premium and applicable taxes. Bids cannot be withdrawn once confirmed.

BUYER'S PREMIUM: A Buyer's Premium of 20% is applied to the Hammer Price for all lots, unless otherwise indicated in the specific listing. This premium is payable by the Buyer and is not included in the hammer price displayed during the auction.

TIME EXTENSION (ANTI-SNIPING): To ensure fairness, any bid placed in the last 2 minutes of an auction will automatically extend the closing time by 2 additional minutes. This process may repeat indefinitely until no new bids are received during the extension period.

AUTOMATIC BIDS (AUTO-BID): Users may set a maximum automatic bid limit. The system will bid on their behalf in the minimum increments necessary to maintain the winning position, up to the established limit. The maximum limit is not revealed to other bidders.

MINIMUM BID INCREMENTS: Minimum increments vary by current lot price: USD $1–$99: $5 increment; USD $100–$499: $25 increment; USD $500–$999: $50 increment; USD $1,000–$4,999: $100 increment; USD $5,000–$19,999: $250 increment; USD $20,000–$99,999: $500 increment; USD $100,000 or more: $1,000 increment.

RESERVE PRICES: Some lots may have a reserve price (undisclosed minimum). If the auction closes without reaching the reserve price, the lot is not sold and no bid is binding. The Platform will indicate if a lot has a reserve price, but will not disclose the specific amount.

LOT CANCELLATION: The Platform reserves the right to cancel, withdraw, or modify any lot before the close of the auction in cases of: (a) dispute over item authenticity; (b) Seller request for justified cause; (c) material error in the lot description; or (d) force majeure circumstances. In case of cancellation, all bids are void.

WINNER PAYMENT: The winning Buyer will receive an invoice within 24 hours of the auction close. Full payment must be made within the following 5 business days. Failure to pay will result in cancellation of the sale, forfeiture of any deposit made, and possible account suspension.

Raffles and draws on the Platform are subject to applicable laws in each jurisdiction. It is the participant's responsibility to verify that participation in online raffles is legal in their place of residence. The Platform does not sell raffle tickets in jurisdictions where such activity is expressly prohibited.

Each raffle ticket grants one chance to win the item described in the listing. The odds of winning depend on the total number of tickets sold, which is indicated in real time on each listing. The Platform guarantees that the draw will be conducted using a verifiable and audited random selection system.

Raffle tickets are non-refundable once purchased, except if the raffle is cancelled by the Platform. In case of cancellation, 100% of the value of purchased tickets will be refunded within 5 to 10 business days.

The raffle winner will be notified by email and through the Platform within 48 hours of the draw. The winner must confirm acceptance of the prize and provide shipping information within 3 days of notification. Failure to respond within that period will result in the selection of an alternate winner and cancellation of the original winner's account for non-compliance.

AUTHENTICITY GUARANTEE: All items listed on the Platform are verified and certified as authentic before publication. The Platform guarantees that each item comes directly from the Seller (the celebrity or authorized entity) and not from third-party collectors, resellers, or intermediaries.

BLOCKCHAIN CERTIFICATION: Each item receives a unique Blockchain Certificate that includes: (a) verified Seller identity; (b) detailed description of the item and its history; (c) high-resolution photographs; (d) item delivery video by the Seller; (e) Seller's digital signature; and (f) immutable record of each ownership transfer.

NFT LINKED TO PHYSICAL ITEM: The Authenticity NFT travels with the physical item in each ownership transfer. The Buyer receives both the physical item and the corresponding NFT. Transfer of the NFT without the physical item, or vice versa, does not constitute a valid ownership transfer under these Terms.

RESALE ROYALTIES: When the Buyer resells an item acquired on the Platform, the blockchain smart contract automatically executes a 10% royalty payment on the resale price, distributed as follows: 7% to the original Seller (the celebrity) and 3% to the Platform. This royalty is non-waivable and inherent to the Authenticity NFT.

AUTHENTICITY DISPUTE: If the Buyer has reasonable grounds to believe an item is not authentic, they must notify the Platform within 30 days of receiving the item. The Platform will investigate the dispute and, if lack of authenticity is confirmed, will offer a full refund including return shipping costs.

The Platform accepts the following payment methods: credit and debit cards (Visa, Mastercard, American Express), bank transfers, cryptocurrencies (Bitcoin, Ethereum, USDC), and other methods indicated during the payment process. Cryptocurrency payments are processed at the exchange rate in effect at the time of the transaction.

BUYER FEE STRUCTURE: Buyer's Premium: 20% on the Hammer Price. Applicable taxes per Buyer's jurisdiction. Shipping and insurance costs per destination (see Section 7). Payment processing fee: 0% for bank transfer; 2.5% for credit card; 1% for cryptocurrencies.

SELLER FEE STRUCTURE: The Platform retains a 15% commission on the final Hammer Price. Sellers receive the remaining 85% of the Hammer Price, plus 7% royalties on each future resale of the item. Seller payments are processed within 10 business days following confirmation of the Buyer's payment.

TAXES: The Buyer is responsible for all applicable taxes in their jurisdiction, including sales taxes, VAT, import taxes, and customs duties. The Platform may be required to collect and remit sales taxes in certain jurisdictions. The final invoice will detail all applicable taxes.

All items are shipped with insurance at their full declared value. The Buyer is responsible for shipping and insurance costs, which will be calculated based on destination, weight, and item value. Estimated shipping costs are shown in the listing, but the final cost will be confirmed in the invoice.

High-value items (over USD $10,000) are shipped exclusively via specialized courier services with documented chain of custody, professional conservation packaging, and full-value insurance. The Platform will coordinate shipping directly with the Buyer for items in this category.

Estimated shipping times are: United States and Canada: 3–7 business days; Europe: 7–14 business days; Latin America: 7–21 business days; Rest of the world: 14–30 business days. These timelines are estimates and may vary due to factors outside the Platform's control, including customs and weather conditions.

The risk of loss or damage to the item transfers to the Buyer at the moment the item is delivered to the carrier. However, since all shipments include full-value insurance, any loss or damage during transport will be covered by the corresponding insurance policy.

GENERAL POLICY: Auction sales are final. Returns are not accepted for change of mind, Buyer error in bidding, or minor discrepancies between the description and the item that do not affect its authenticity or material value. This policy is consistent with the WCF Global Holdings LLC platform standards and its certified memorabilia auction protocols.

EXCEPTIONS TO NO-RETURN POLICY: Returns will be accepted and full refunds issued only in the following cases: (a) the item is not authentic as certified; (b) the item received is materially different from what was described in the listing; (c) the item arrives with undisclosed damage that significantly affects its value; or (d) the item is not delivered within 60 days of payment.

DISPUTE PROCESS: To initiate a dispute, the Buyer must: (1) notify the Platform in writing within 30 days of receiving the item; (2) provide detailed photographs of the item and packaging; (3) specifically describe the discrepancy or problem; and (4) keep the item in its original condition without alterations. The Platform will resolve the dispute within 15 business days of receiving complete documentation.

ARBITRATION: Any dispute that cannot be resolved through the Platform's internal process will be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will be conducted in English and Spanish, in the city of San Juan, Puerto Rico, or virtually. The arbitrator's decision will be final and binding on both parties.

All content on the Platform, including but not limited to texts, images, videos, logos, designs, source code, and the WCFAuction / World Celeb Finds brand, is protected by copyright, trademarks, and other intellectual property laws. Reproduction, distribution, or commercial use without express written authorization is prohibited.

Delivery videos produced by the Platform as part of the Blue Sky Carpet program are jointly owned by the Platform and the corresponding Seller. The item Buyer receives a non-exclusive license for personal use of the video linked to their item's Authenticity NFT, but has no commercial distribution rights.

By publishing content on the Platform (including reviews, comments, or photographs), the user grants the Platform a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute such content for the Platform's operational and promotional purposes.

The collection and use of personal data is governed by our Privacy Policy, available on the Platform. By accepting these Terms, you also accept our Privacy Policy. We collect data necessary to operate the Platform, process transactions, verify identities, and fulfill legal obligations.

Transaction data, including bid and purchase history, may be shared with tax and regulatory authorities when required by law. The winning Buyer's identity data may be shared with the Seller exclusively for shipping and item certification purposes.

The Platform implements appropriate technical and organizational security measures to protect personal data against unauthorized access, loss, or destruction. However, no internet transmission system is 100% secure, and the Platform cannot guarantee the absolute security of transmitted data.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

The Platform's total liability to any Buyer for any claim related to a specific transaction shall not exceed the total amount paid by the Buyer in that transaction. This limitation applies regardless of the legal theory under which the claim is brought.

The Platform acts as an intermediary between Sellers and Buyers. We are not responsible for the actions or omissions of Sellers, the accuracy of descriptions provided by Sellers (beyond our authenticity verification), or events outside our reasonable control.

The following are strictly prohibited on the Platform: (a) placing fictitious bids or coordinating bids with other users to manipulate prices (bid shilling or bid rigging); (b) creating fake accounts or using third-party identities; (c) attempting to circumvent the Platform's security or authentication systems; (d) listing counterfeit or questionably authentic items; (e) using the Platform to launder money or finance illicit activities.

Also prohibited: (f) harassing, threatening, or intimidating other users, Sellers, or Platform employees; (g) using bots, automated scripts, or any non-human means to place bids or acquire raffle tickets; (h) reselling raffle tickets to third parties; (i) attempting to directly contact Sellers to conduct transactions outside the Platform; (j) publishing defamatory, obscene content or content that violates third-party rights.

Violations of these prohibitions may result in: temporary or permanent account suspension; cancellation of active bids and pending transactions; retention of funds in the payment process; reporting to competent authorities; and civil or criminal legal action as appropriate.

The Platform reserves the right to suspend or terminate any account, with or without prior notice, for violation of these Terms, fraudulent activity, payment non-compliance, or any conduct the Platform deems harmful to the community or Platform integrity.

The user may cancel their account at any time from their profile settings. Cancellation does not affect pending obligations, including payments owed for won auctions or transactions in process. User data will be retained for the period required by applicable law.

Upon account termination, the user loses access to the Platform but retains ownership of acquired physical items and NFTs, as well as the right to receive future royalties from resale of items sold as a Seller.

These Terms are governed by the laws of the Commonwealth of Puerto Rico and applicable federal laws of the United States of America, without regard to its conflict of law provisions. For users in the European Union, the provisions of the General Data Protection Regulation (GDPR) and the Consumer Rights Directive shall additionally apply. In the event that the principal operating headquarters is relocated to another U.S. state through agreement with a strategic partner, the applicable jurisdiction will be updated accordingly.

Any legal action not submitted to arbitration under Section 8 shall be brought exclusively before the competent courts of San Juan, Puerto Rico. The parties submit to the personal and exclusive jurisdiction of those courts and waive any objection based on inconvenient forum.

The Platform reserves the right to modify these Terms at any time. Substantial modifications will be notified to registered users by email at least 30 days in advance. Continued use of the Platform after the effective date of the new Terms constitutes acceptance thereof.

For transactions in progress at the time of a Terms modification, the Terms in effect on the date the bid or purchase was made will apply, unless the modification is required by applicable law or regulation.
